How long do I have to file a car accident claim in Florida?

For most car accidents occurring after March 24, 2023, Florida's statute of limitations is two years from the date of the crash. What is the 14-day rule after a car accident in Florida?

Florida's no-fault law requires you to seek medical treatment within 14 days of a car accident to qualify for your $10,000 in Personal Injury Protection (PIP) benefits. If you wait longer than 14 days, you forfeit PIP coverage entirely — regardless of how serious your injuries are. Because injuries like concussions and whiplash can have delayed symptoms, get evaluated promptly even if you feel fine.

When can I sue the other driver instead of just using PIP?

Florida's no-fault system lets you step outside PIP and sue the at-fault driver for full damages — including pain and suffering — when your crash caused a permanent injury, significant and permanent loss of an important bodily function, significant and permanent scarring or disfigurement, or death. What if I was partially at fault for the crash?
